Porn ruling: Threat to free speech

First sentence(s): Washington, DC – In a decision that raises the specter of ex post facto legislation and unchallengably overbroad laws, the US Supreme Court ruled June 21 that a conviction obtained under a 1982 Massachusetts pornography law could still stand even though the law was ruled unconstitutional by Massachusetts’ highest court in 1988. In a confusing decision that sharply split the justices, the Court remanded the case back to the state’s Supreme Judicial Court (SJC) to decide whether a photo Douglas Oakes took of his partially naked 14-year-old stepdaughter was expression protected by the First Amendment.
